No-Fault & Administrative Separation

In Jersey’s high-value offshore economy, private wealth is heavily concentrated in complex discretionary trusts, multi-layered holding companies, and premium real estate.

Statutory reforms passed by the States Assembly have dismantled the historical barriers of assigning blame, transforming the legal mechanics of ending a marriage. However, while obtaining the dissolution itself is now a streamlined administrative milestone, the division of marital wealth remains a high-stakes, adversarial testing ground.

Allowing a separation to be guided by passive, administrative handlers gives an opponent the exact window they need to quietly alter trust distributions, shift liquid assets to opaque jurisdictions, or manipulate corporate valuations under the guise of an amicable transition. Sinels delivers the decisive, trial-ready courtroom strategy required to expose hidden capital, shield your assets, and dictate the terms of your financial remedy.

Shield your capital, expose shadow holdings, and lock in your financial autonomy under modern law.

The Illusion of the Administrative Gateway: Why Standard Firms Underperform

Standard offshore law firms frequently approach Jersey’s modern dissolution framework with a relaxed, box-ticking mindset.

They treat the administrative shift as an excuse to lower their guard, drifting into endless loops of polite, voluntary mediation and passive account reconciliations. They fail to realise that while the new law makes it impossible to contest the divorce itself, it does absolutely nothing to alter the inherently competitive nature of complex financial remedy proceedings.

At Sinels, we treat no-fault and administrative separations as intensive serious litigation. Led by Philip Sinel, our advocates understand that the new law simply accelerates the timeline, clearing away procedural clutter so we can strike directly at the finances from day one. We operate with a trial-ready strategy, methodically forcing comprehensive disclosure, tracking hidden assets, and utilising the full power of the Royal Court of Jersey to ensure your corporate and personal capital remains heavily insulated.

Our Strategic Separation & Asset Protection Framework

Modern No-Fault Dissolution & Joint Application Audits

We manage single or joint dissolution filings under the modernised framework, completely bypassing outdated fault-based allegations and the historic three-year marriage bar.

By handling the administrative transition with absolute precision, our team eliminates tactical delays and locks the counterparty into an inescapable statutory timeline.

This removes artificial emotional flashpoints, immediately advancing the case straight to the core financial remedy arena without wasting billable hours on blame allocation.

Forensic Wealth Tracing & Shadow Trust Discovery

Our advocates execute deep-dive forensic cross-border asset tracking across corporate structures, foundations, and offshore banking systems parallel to the administrative separation.

We enforce absolute compliance with financial disclosure requirements, compelling your opponent to declare all worldwide vested or contingent interests under oath while penalising fraudulent omissions.

This accurately establishes the true limits of the matrimonial pot, neutralising attempts to mask corporate distributions or shield resources behind nominee screens.

Financial Remedy Enforcement & Litigating Gross Conduct

We pursue high-stakes financial remedy awards before the Samedi Division of the Royal Court, leveraging statutory rules on needs, resources, and economic contributions.

Although fault is removed from the initial divorce petition, we methodically expose and prove financial dissipation, asset hiding, or coercive commercial control directly within the financial remedy proceedings. These bad-faith counterparty manoeuvres are translated into significant structural adjustments, protecting your capital and securing your true equity.

Why Corporate Leaders and Asset Holders Instruct Sinels

Sinels is a litigation firm with a thirty-year track record in Jersey’s most demanding asset-tracking, trust, and commercial court disputes. We operate completely free of the institutional conflicts of interest that prevent large, full-service offshore practices tied to major trust corporations or banking syndicates from acting. We don’t write passive advisory notes or encourage timid compromises that devalue your net worth; we build the evidence, take the points that are actually available, and are ready to run the matter to a hearing if it comes to that.

Frequently Asked Questions About No-Fault & Administrative Separation

How does Jersey’s no-fault divorce framework change the timeline of a separation?

The framework abolishes the historic three-year marriage bar, allowing couples to apply for a dissolution immediately. It introduces a two-stage process featuring a mandatory six-month window between the initial ‘conditional order’ and the ‘final order’.

This interim period provides the necessary time to resolve complex financial remedies and child arrangements before the legal union is permanently dissolved.

Does the administrative separation process mean that marital conduct is entirely ignored?

No. While conduct is no longer used as grounds for the divorce petition itself, it remains highly relevant in financial remedy proceedings.

Under Jersey law, behaviours such as financial dissipation, coercive economic control, or any conduct of a ‘gross and obvious’ nature must be forcefully pleaded. Sinels presents these forensic facts to the Royal Court to secure a structural adjustment of the final asset division in your favour.

If a divorce cannot be contested under the new law, how are financial assets protected?

Although the dissolution itself cannot be contested, the right to litigate the division of wealth remains entirely unaffected. If a spouse attempts to hide capital or split assets inequitably, Sinels secures emergency interim injunctions and arrêts entre mains from the Royal Court. This freezes bank accounts and corporate registries to preserve the matrimonial assets until a final financial order is determined.
