Civil & Property Disputes

In Jersey’s high-value real estate and corporate economy, a civil contract default or a property boundary dispute poses a direct threat to operational liquidity, corporate valuation, and developer returns.

Allowing these disputes to linger in polite correspondence or open-ended alternative dispute resolution gives adversaries the runway to erode project margins, cloud land titles, and freeze critical capital.

Sinels delivers rigorous courtroom advocacy and decisive tactical countermeasures to secure your assets, resolve structural gridlocks, and protect your commercial interests.

Dismantle bad-faith commercial claims, lock down real property boundaries, and enforce contract compliance.

Standard offshore law firms frequently approach civil litigation and property disputes with a detached, compliance-driven mindset.

They treat complex title defaults or high-stakes structural breaches as simple administrative discrepancies, trapping commercial interests in protracted loops of pre-action correspondence and slow-moving mediation.

This runs up substantial billable hours while core developments remain gridlocked and operational funds sit frozen.

At Sinels, we treat civil and property disputes with absolute commercial gravity. Led by Philip Sinel, our advocates operate with a disciplined strategy that prepares for trial from the outset. We do not wait for the opposition to concede or slowly supply discovery.

Instead, we identify precise procedural and customary pressure points, exploit compliance gaps in the counterparty’s file, and launch rapid, decisive claims via an ‘Order of Justice’ to force opponents onto the defensive and achieve immediate tactical supremacy in the Royal Court of Jersey.

Our Strategic Civil & Property Litigation Framework

High-Value Commercial Property & Heritage Division Battles

We litigate high-net-worth real estate disputes, leasehold terminations, and complex boundary impairments before the specialised Heritage Division of the Royal Court.

By systematically deconstructing flawed surveys and dismantling aggressive commercial tenant tactics, we enforce strict contractual compliance regarding structural dilapidations.

This approach protects your property’s capital valuation, eliminates boundary overreach, and unlocks frozen development pipelines.

Order of Justice Enforcement & Contractual Prescription Defence

Our advocates draft and execute definitive Orders of Justice for immediate service while deploying Jersey’s strict customary law rules on prescription.

We enforce the 10-year prescription period for contractual breaches and the tight 3-year limitation for tortious actions, extinguishing stale claims before they can impact your balance sheet.

This strategy forcefully dismisses vexatious or out-of-time financial claims, preserving your liquid reserves and insulating corporate directors from historic liabilities.

Emergency Interim Remedies & Customary Law Injunctions

We secure immediate interim measures, including ex parte freezing injunctions (Mareva relief), arrêt entre mains, and the ancient Norman customary law injunction of the Clameur de Haro.

Operating without prior warning to the counterparty, we freeze local assets or halt unlawful construction encroachments instantly. This ensures you maintain full operational and physical control, preventing the opposition from altering facts on the ground while the substantive trial proceeds.

Why Commercial Leaders and Landowners Instruct Sinels

Sinels is a dedicated litigation firm with a thirty-year record of resolving Jersey’s most complex commercial asset, trust, and administrative disputes. We operate free from the institutional conflicts of interest that restrict large, full-service offshore firms tied to major developers, clearing banks, or public bodies.

Rather than issuing passive advisory memos, we execute decisive courtroom strategies designed to protect your interests and maximise your legal leverage from the moment you instruct us.

Frequently Asked Questions About Civil & Property Disputes

How does an “Order of Justice” differ from a standard UK claim form?

Unlike a brief UK claim form, a Jersey Order of Justice is required for civil actions exceeding £30,000.

It serves simultaneously as a summons and full particulars of claim, requiring the signature of a Jersey Advocate and formal judicial authorisation.

Because it demands a fully evidenced legal basis at the outset, a meticulously drafted Order of Justice prevents procedural delays and compels the defendant to respond within a compressed timeline.

Can the ancient “Clameur de Haro” still be deployed to halt property development?

Yes. The Clameur de Haro remains an active and powerful interim remedy under Jersey customary law.

It functions as an immediate injunction for an individual who has been in peaceful possession of real property for at least a year and a day, and whose enjoyment is actively disrupted by a physical encroachment, such as an unlawful boundary demolition.

Once the ancient Norman invocation is formally raised before witnesses, the counterparty must cease all work immediately or face criminal contempt of court pending a review by the Royal Court. Given the severe financial penalties for an improperly raised Clameur, expert legal guidance is essential.

What is the law of “prescription” in Jersey contract and tort claims?

Jersey claims are governed by the customary law principle of prescription rather than the UK Limitation Acts.

For breach of contract, the prescription period is 10 years from the date the cause of action accrued.

For tort claims, including negligence, misrepresentation, and property damage, the limit is strictly 3 years.

Missing these deadlines creates an absolute bar that completely extinguishes the substantive legal right, making early evaluation of timelines critical.
