Some HMRC investigations go far beyond the “lawful and rational” and enter the realms of “illegality and absurdity”.
The Multi-County Dawn Raids
In one case, HMRC deployed 100 officers across five English counties, executing simultaneous dawn raids, taking doors off their hinges, and tearing apart bedrooms in search of luxury sports cars, crypto and hidden cash.
HMRC’s actions were misinformed and unlawful from the very start.
Worse still was the fact that similar scenarios were playing out on other continents with prosecutors even publishing self congratulatory press releases, in which clients could be actually be recognised.
Flawed Assumptions: “Sales Suppression Software”
Investigators had convinced themselves that our clients were deploying automated sales suppression software: a malicious “two-sets-of-books” architecture designed to covertly shave down reported revenue.
This was a buzzword invented by law enforcement.
It’s a rare occurrence - but does happen, mainly in the United States and Canada.
The reality, however, was vastly different.
The business was founded by an immigrant and his humble peers, who worked and worked to build a legitimate business; they were highly successful.
Their business model maximised assistance for its humble, but numerous clientele.
It coincidentally safeguarded at least a thousand jobs.
In short, let’s acknowledge - it actually increased taxable revenues.
After two sets of English lawyers failed to move the needle, Sinels stepped in.
The Turnaround: Proof Over Speculation
Using a pristine, untouched version of the software securely preserved with specialists in England, we asked, from a position of strength, “where is your proof?”.
Shortly thereafter, all hostility was magically dropped.
We had an abandonment letter.
The business was driving sales, and the tax on sales was going up - not down.
We also co-ordinated efforts in the other countries involved, recruiting specialist lawyers and experts.
A lawful, fact-based, co-ordinated response ultimately led to a complete withdrawal of all action - everywhere.
It was a chilling reminder of how easily enforcement agencies can fall into flawed technical assumptions, as seen in the infamous Post Office scandal.
Global Coordination & Full Withdrawal
But, unlike those tragic proceedings, this story thankfully underwent a prompt correction.
Eventually, the facts - and reality - caught up with the enforcement agencies.
Lawfully obtained human intelligence subsequently confirmed the end of HMRC’s intent.
The case had dissolved completely.
When legal strategy follows facts rather than phantoms, even an international taskforce has no choice but to pack up and go home.
